The terms for using Speek.

These terms govern access to Speek's website, demos, and the Speek CRM: its pipeline, research, outreach by email, calls and WhatsApp, the websites it hosts, and related services. A signed order form may add or replace commercial terms for a customer.

1. Agreement and eligibility

By accessing or using Speek, you agree to these terms. If you use Speek for an organisation, you confirm that you have authority to bind that organisation. You must be legally able to enter a contract and provide accurate account information.

2. The service

Speek is a CRM that sells for you. It learns your business from your website into a Business Brain, researches companies that may need what you sell, keeps every lead in one pipeline, and, once you approve it, contacts and follows up with them by email, calls and WhatsApp. It can also build, host and measure a website for your business. Features may differ between a public demo, a trial, and a paid plan. We may improve or change the service while preserving material contracted commitments.

3. Accounts and access

You are responsible for protecting account credentials, limiting access to authorised users, and promptly telling us about suspected misuse. Activity performed through your account is treated as authorised unless you notify us of a security issue.

4. Customer responsibilities

You are responsible for:

  • the legality and accuracy of instructions, your Business Brain, contacts, phone numbers, website content, and anything else you supply to Speek;
  • reviewing the companies and people Speek finds, and each message, before you approve outreach to them;
  • complying with the marketing, anti-spam, telemarketing and data-protection laws that apply to the people you contact, including giving required notices and obtaining consent for calls, automated communications, transcription, and recording;
  • keeping the unsubscribe link Speek adds to every outreach email, and adding anything else the law requires where you send, such as a postal address;
  • following the rules of the channels you use, including your mailbox provider's sending limits and Meta's WhatsApp Business policies;
  • configuring human escalation and review for sensitive, regulated, or high-impact workflows;
  • honouring opt-outs, suppression requests, calling-hour rules, and other communication restrictions; and
  • having the speaker's consent before cloning a voice, and never using a voice to impersonate someone or mislead the people you contact;
  • the claims made on your website and in your messages, including prices, reviews and results, which must be true.

5. Acceptable use

You may not use Speek to break the law, deceive or harass people, impersonate a person without authority, send spam or place unlawful unsolicited calls, contact someone who has opted out, publish a website that is misleading or infringes someone else's rights, collect prohibited secrets, bypass consent or suppression controls, interfere with the service, distribute malware, or develop a competing model through unauthorised extraction. We may suspend activity that creates legal, security, safety, or operational risk.

6. AI and automated actions

Speek records facts with the source it took them from so you can check them, and sends nothing to a new contact until you approve it. Even so, research, voice and language models can misread a page, misunderstand speech, generate inaccurate content, or behave unexpectedly. Speek should not be the sole basis for medical, legal, financial, employment, eligibility, emergency, or similarly high-impact decisions. You must define appropriate limits, permissions, testing, and human review for your use case.

7. Fees and payment

Fees, included usage, implementation work, billing frequency, taxes, and payment terms are set out on the pricing page, proposal, or order form accepted by the customer. Usage beyond an included allowance may be charged at the agreed rates. Except where law or an order form says otherwise, paid fees are non-refundable.

8. Customer data and intellectual property

You retain ownership of content and data you provide. You grant Speek the limited rights needed to host, process, transmit, and secure that data to provide the service. Speek retains ownership of its software, designs, models, documentation, and service improvements. Feedback may be used without restriction or an obligation to compensate you.

9. Privacy and confidentiality

Our Privacy Policy explains how personal data is handled. Each party will protect the other's non-public business, technical, and commercial information and use it only for the service or agreement, except where disclosure is legally required.

10. Third-party services

Speek relies on and may connect to third-party mailbox (Google and Microsoft), telephony, WhatsApp, speech, model, research, hosting, domain, authentication, payment and customer systems. Their availability and separate terms may affect connected features. You are responsible for third-party accounts that you choose to connect, and for any domain you point at a website Speek hosts.

11. Suspension and termination

You may stop using Speek at any time, subject to an order form. We may suspend or terminate access for material breach, non-payment, unlawful use, security risk, or harm to the service or others. On termination, outstanding charges remain due, websites Speek hosts for you may be taken offline, and data is handled under the agreement and Privacy Policy.

An account on no paid plan that shows no activity (no sign-in and no message in its WhatsApp group) is paused after 14 days, which takes the websites it runs alone offline, and is deleted with its data after 60 days. We email the account before it is paused and again before it is deleted, and signing in at any point before deletion restores it as it was.

12. Service disclaimer and liability

To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Speek is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill. Any aggregate liability limit and exceptions will be defined in the applicable order form and mandatory law.

13. Changes, law, and contact

We may update these terms and will identify the effective date. Material changes will be communicated where required. The governing law, dispute process, notices, and contracting Speek entity for a paid plan will be stated in its order form. Questions can be sent to support@usespeek.app.
